Abstract:The Constitution of the People’s Republic of China defines that the village committee is the grassroots self-governing organization. Therefore, the village planning and development control system is quite different from the system in city and town. The present rural planning system is a copy of the urban version, and it neglects the contexts of villager’s self-governance. Base on the study of post-disaster reconstruction of Caojia village in Baoxing in Sichuan Province, it argues the framework of village planning and development control must be established on the base of villager’s governance. A fair and efficient village planning and control system has to focus on the relationship between executive power and self-governing power, law and bylaw, statute law and common law, local (basic level) government and village committee, traditional construction methods and requirements for modern life.
